NOTICE REGARDING DISPUTE RESOLUTION: THESE TERMS CONTAIN PROVISIONS THAT GOVERN HOW CLAIMS YOU AND RARE BEAUTY HAVE AGAINST EACH OTHER ARE RESOLVED (SEE THE “DISPUTE RESOLUTION AND ARBITRATION AGREEMENT” SECTION BELOW), INCLUDING AN OBLIGATION TO ARBITRATE DISPUTES, WHICH WILL, SUBJECT TO LIMITED EXCEPTIONS, REQUIRE YOU TO SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING ARBITRATION.

These Terms of Service (“Terms”) apply to your access to and use of our website and other online or mobile products and services (collectively, our “Services”) provided by Rare Beauty, LLC (“Rare Beauty” or “we”). If you use our Services to purchase any of our cosmetics, beauty products, or other goods we offer for sale (collectively, our “Products”), such purchase is governed by these Terms, including the Terms of Sale in Section 12 below (unless shipping outside the United States, which falls under Section 13). If you purchase or redeem a gift card for Products, Section 14 also applies.

If you do not agree to these Terms, please do not use our Services.

We may provide additional terms for specific Services, which become part of your agreement if you use them. In case of conflict, these Terms prevail, including any arbitration or dispute resolution provisions.

We may update these Terms periodically. We’ll notify you via email, site posting, or other means. Check the “Last Updated” date for changes. Updates take effect immediately upon posting.

1. Privacy

For details on how we collect, use, share, and process your information, refer to our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use our Services. If under 18 (or legal majority age in your area), use only with parent or guardian supervision, who agrees to these Terms. Parents/guardians are responsible for minors’ actions. If using on behalf of others, you represent authority, and both are bound.

3. User Accounts and Security

You may need an account for certain features. Provide accurate information and update as needed. Secure your account and notify us of unauthorized access. You’re responsible for activities under your credentials. We may reclaim usernames for legitimate claims.

4. User Content

Our Services allow posting content like text, photos, videos (“User Content”). You retain rights except for the license granted. You provide Rare Beauty a perpetual, nonexclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, distribute, and display your User Content without compensation.

User Content may be visible to others. Do not post without necessary rights. You warrant no violations. We may remove User Content anytime. This section addresses intellectual property, not data protection rights.

5. Browsing Session Information

We track sessions, chats, and activities using technologies like session replay, cookies, pixels for quality, service, fraud prevention, security, marketing, per our Privacy Policy.

6. Prohibited Content and Conduct

You must comply with laws and rights; you’re responsible for your actions. Prohibited actions include:

• Selling or reselling Products/Services commercially.
• Harassing or threatening behavior.
• Impersonation or misrepresentation.
• Copying, modifying, or deriving from Services without permission.
• Interfering with or disrupting Services.
• Reverse engineering or bypassing restrictions.
• Data mining or scraping.
• Developing unauthorized apps.
• Ignoring robots.txt.
• Illegal or unauthorized use.

Post only nonconfidential, rights-cleared User Content. Prohibited User Content includes:

• Unlawful, defamatory, obscene, harassing material.
• Criminal encouragement or rights violations.
• Infringing intellectual property.
• False statements.
• Impersonation.
• Unsolicited promotions.
• Private info without consent.
• Harmful files.
• Objectionable content harming others or Rare Beauty.

Enforcement is at our discretion; no waiver or third-party rights created.

7. Ownership; Limited License

Services content is owned by us or licensors, protected by laws. You get a limited, revocable license for personal, noncommercial use. Unauthorized use terminates license and violates rights.

8. Trademarks

Rare Beauty, R Monogram Logo, and our marks may not be used without permission. Other marks are property of owners; no endorsement implied.

9. Feedback

Feedback you provide can be used by us without compensation or acknowledgment. Treated as nonconfidential.

10. Repeat Infringer Policy; Copyright Complaints

We terminate repeat infringers per DMCA. For infringement claims, notify our agent:

11. Third-Party Content

We may offer third-party info (“Third-Party Content”). Interactions with it are your responsibility. We don’t control or endorse; use at your risk.

12. Terms of Sale

These apply to Product purchases. Agree by purchasing.

If shipping outside U.S., see Section 13.

A. Order Eligibility

Valid billing/shipping address in selectable countries required.

B. Product Availability, Display, and Specifications

Product details on Services subject to change. We strive for accuracy but no guarantees. Products may be unavailable or differ from descriptions. We make reasonable efforts to publish accurate information and display Products reliably. Packaging may vary; always read labels for safe use.

C. Purchase Restrictions and Quantity Limits

Purchases for personal use only, not resale. We may limit quantities and refuse or reject orders anytime, refunding payments.

D. Order Process; Errors

Review and confirm order before submission. We send acknowledgment email; acceptance upon sending. We handle shipment; you pay specified charges. Title and risk pass upon carrier receipt. Shipping dates are estimates; no liability for delays.

We may refuse or cancel orders for errors or inaccuracies, contacting you if needed.

E. Price

Prices exclude taxes/shipping, added at checkout. Subject to change without notice.

F. Payment

We offer various options, changeable anytime. Payment required before acceptance. You warrant authorization and accuracy; charges honored. Reimburse collection costs if needed. Refunds to original method or store credit.

G. Return Policy

In addition to statutory rights, return within 30 days for refund (shipping non-refundable). Returns only from original shipment country, via designated portal.

We may decline ineligible returns. Refunds upon receipt, to original method or store credit. For gifts or Gift Cards, specific rules apply.

H. Return Procedure

Initiate via self-service portal with order details. Select items and refund option; receive pre-paid label.

Refunds processed upon receipt; time varies by provider. Ineligible items not returned.

13. International Orders

We partner with Global-e for non-U.S. shipments. Redirected to Global-e; their terms apply instead of Section 12.

14. Gift Card Terms

Apply to Gift Card purchases/redemptions.

A. Purchase

Purchased via Services; valid email required. Discounts may not apply.

B. Redemption

Redeem for Products on Services; tax may apply. U.S. residents only.

C. Expiration; Restrictions

No expiration; non-reloadable, non-transferable, non-cash redeemable except by law.

D. Returns; Risk of Loss

Refunds as store credit. Risk passes upon transmission; not responsible for loss or misuse.

E. Termination

We may suspend/terminate for violations or suspicious activity.

15. Indemnification

You indemnify Rare Beauty Parties from Claims arising from your use, content, violations, or conduct. Notify, cooperate, pay costs; we control defense.

16. Disclaimer of Warranties and Release

Use at your risk; provided “as is” without warranties. No guarantees of accuracy or safety. You release us from liabilities, except non-excludable ones.

Some jurisdictions limit exclusions.

For UK/EEA consumers, we provide with reasonable skill; doesn’t limit consumer rights.

17. Limitation of Liability

Not liable for indirect damages or lost profits, even if advised. For UK/EEA, not liable for unforeseeable losses.

Doesn’t limit non-excludable liabilities like death/injury from negligence.

Some jurisdictions limit exclusions.

18. Transfer and Processing Data

We may process/transfer data globally; see Privacy Policy.

19. Dispute Resolution; Binding Arbitration

Read carefully: Requires arbitration, no class actions, limits relief.

Informal Resolution: Good faith effort first, including call. Notify via email; 60 days to resolve. Tolls statutes.

Arbitration: Per AAA Rules; binding, no jury. Confidential. FAA applies. Court decides arbitrability.

Begin by letter to address. Offers per CCP 998.

We pay prohibitive costs unless attorney advances. Split initially if recovery-contingent.

Doesn’t preclude agency actions or small claims.

Provisional relief allowed.

No class actions; individual only. Arbitrator limits; public injunctions in court after arbitration.

Severability; survives termination.

Mass Arbitration: Staged process for 25+ similar claims; batching, mediation. Tolls statutes.

21. Language

Agreement in English only.

22. Governing Law and Venue

California law, except preempted. Actions in LA courts if not arbitrated/small claims.

Local law may apply if required.

23. Modifying and Terminating our Services

We may modify/suspend Services anytime. Not liable for related loss, except non-excludable.

24. SMS Program

Agree to recurring texts; not purchase condition. Rates apply; frequency varies.

Carriers not liable.

25. Severability

Invalid provisions severed; rest enforceable.

26. Miscellaneous

No waiver from failure to enforce. Titles for convenience. No third-party beneficiaries. Electronic communications. Assignable by us.
